完善我国彩礼返还法律规则的思考

Reflection of Improving the Statutory Rules about the Return of Betrothal Gifts in China

我国司法解释设置的彩礼返还规则,在解决彩礼返还纠纷中发挥了重要作用。但现行彩礼返还规则过于简单,显得粗糙,在司法审判中出现很多问题,引发了许多争议;不同地区的法院,甚至是同一法院的法官对同一性质的案件往往达不成统一的认识,导致对同一性质的案件有着不同甚至截然相反的判决。鉴于彩礼返还在现实生活中引发大量的民事纠纷,以至引发刑事犯罪。对彩礼问题进行必要的分析,针对现实中出现的相关法律问题提出一些解决方案,作为立法建议,有助于统一认识,规范司法行为,减少社会矛盾,实现社会公平,促进社会和谐。

China＇s judicial interpretation has set the rules of the return of betrothal gifts, which play an impor tant role in dealing with the disputes in the return of betrothal gifts. However, the current rules of the return of be trothal gifts are excessively simple and rough, thus cause much controversy. The courts in different areas and even the judges of the same court often fail to reach a unified understanding to the same case, leading to different and e ven opposite judgment to the same case. The return of betrothal gifts in realistic life triggers a large number of civil disputes and even criminal offenses, so it is necessary for us to analyze the problems of betrothal gifts and propose some solutions to the legal issues related to reality as legislative proposals to help unify the understanding, standard ize judicial practices, reduce social conflicts, realize social ectuality and promote social harmony.
