我国城市房屋征收补偿立法后评估——以《国有土地上房屋征收与补偿条例》为例

《国有土地上房屋征收与补偿条例》的颁布施行,标志着我国城市房屋征收补偿立法制度进入了一个新阶段。但实行近一年来,全国强制拆迁事件频发不止,极大地影响群众对于我国立法的信任感以及地方执法工作的开展。立法后评估方法早在西方国家广泛应用,对立法完善和法治建设起到很大的作用。以《国有土地上房屋征收与补偿条例》为例,分析其实施效果及相关制度,建立我国城市房屋征收补偿立法后评估体系,也为我国立法后评估体系建立提供参考。

The promulgation of Tax and Compensation Ordinance of The Houses on the State - owned Land is a sign of a new step for our country urban - house collection of compensation. However in the recent one year since the implementing, forced removals events have never stopped , which make a bad influence on the foundation of people＇s belief in our country legislation and law enforcement work of the local government. The after - legislation evaluation has been ap- plied in many western countries, promoting the legislation and legal construction. This article takes Tax and Compensa- tion Ordinance of The Houses on the State - owned Land as the example to analyze its effect of implementation and related system, in hopes of building up the system of after- legislation evaluation of our country＇s urban- house collection of compensation and providing suggestions for the after - legislation evaluation system of the whole legislation work.
