我国医生拒证权的可行性研究——从法律移植的视角

Studying on the feasibility of doctors' privilege in China in view of legal transplant

医生拒证权作为一种新型的拒证权制度,理论上具备了法律移植的广泛性。随着患者隐私权意识的增强,这种立法上的完善也是大势所趋。文章从理论、历史、现实性方面来对我国法律移植的可行性进行讨论。最后论述了操作不能操之过急,反而欲速而不达。

As a new-type privilege system, doctors＇ privilege has obtained the theoretical universality of legal transplant. With the strengthening of patients＇ right of privacy, perfection in legislation has been inevitable. The feasibility of legal transplant was discussed from aspects of theory, history and reality. And it was emphasized that overhastiness must be avoided.
