论行政自由裁量权与个案的公平正义

On the Administrative Discretion and the Justice of Individual Case

行政自由裁量权具有四方面的要素,它在法治社会有其存在的合理性和必要性,其本身亦蕴含着公平正义性,在实践中,由于诸多原因的存在导致行政自由裁量权的被滥用,为了实现个案的公平正义,应从立法限制、司法审查和制度建设等方面着手对行政自由裁量权予以限制。

The administrative discretion has four key elements that have a quality of reason,necessity and justice.In implementation,the administrative discretion is used with wrong,in order to realize the Justice of individual case,we should confine the administrative discretion on the making law,the judicialreview and construction of system.
