湖南省M市C镇S村土地问题引发的思考

土地问题历来是中国社会问题的焦点,中国历史上关于土地所有权和使用权的归属争论也一直存在。本文的案例中,历史原因及农村集体土地所有权主体的模糊性引发了保护耕地"红线"与保障"民生"之间冲突,也是当前普遍存在的现象。通过调查研究,针对该案例所呈现的问题,本文认为需要完善我国现有土地法律体系,改革农村土地集体所有制;解决土地规划滞后问题,实施有效的法律保护;改进基层国土监察工作以及可以考虑发挥农民自律合作组织的作用。

The land problem has always been a focus of social problem in China, meanwhile, the controversy of the ownership of land and its use right has existed in Chinese history until now. In the case of this paper, the problem caused by historical reasons and the fuzziness of the subject of the rural collective land ownership resulted in the conflict between the protection of the land red line and the guarantee of the people＇s livelihood at present. According to the problem in the case, four suggestions are given as follows： 1. to perfect the current domestic land law system and reform the ownership of the rural collective land; 2.to resolve the delay problem of land planning and implement effective law protection; 3. to improve the grass-roots land supervision work; 4. to establish farmers＇ association.
