五保户与政府是公法上的权利和义务关系,政府不能因为对五保户的管理和供养取得对五保户的财产权利;死亡赔偿金是对死者亲属的赔偿,不属于遗产,政府无权取得五保户死亡的死亡赔偿金。

The relationship between Wu Bao Hu and the government is that of the rights and duties in public law. The govern ment couldn＇t get the property rights of Wu Bao Hu because of its administration and help for Wu Bao Hu. Death compensation is just for relatives of Wu Bao Hu and it isn＇t the heritage so that the government has no rights of it.
