摘要
广州的小产权房发展过程和当地政府在集体建设用地使用权流转政策上的创新表明,我国农村集体土地流转制度的正当性正遭遇质疑,允许集体建设用地使用权入市是农村经济纵深发展的需要,也是未来农村土地改革的趋势。我国法律对集体建设用地使用权流转的简单禁止并非良策,相反应在明确我国农村集体土地所有权的权利性质的前提下,借鉴广州的一些创新举措,循序渐进地取消这些限制,并逐步建立和完善流转机制。
In Guangzhou,the developments of houses with limited property rights and the local government's innovation on policy for the circulation of the right of the rural collective-owned land(RCOL) for construction indicates that the legality of the RCOL circulating system in our country is being questioned.It is not only necessary for the right of the RCOL to be permitted to access to the market,but also a trend for the future reform of rural land,for which the relevant policies of Guangzhou should be confirmed and promoted.It is not a good policy for just simply prohibiting the circulation of the right of RCOL by legislation,on the contrary,the law of our country shall cancel the restrictions step by step,and found a mechanism for circulation according to the nature of the RCOL.
