我国驰名商标保护制度的反思与完善

Self-examination and Improvement on Well-known Trademark Protection in China

在商标法第三次修改的过程中,反思我国驰名商标保护制度建立、发展过程中的成绩与问题,就我国驰名商标保护制度应该继续坚持以"混淆论"为基石还是修改为以"反淡化论"为基石、在立法上有无必要规定"驰名商标的个案认定原则"、应否禁止驰名商标的广告宣传等问题进行探讨,以期对驰名商标保护制度的完善提出建议。

During the course of the 3rd amendment of the trademark law, all the aspects regarding the establishment and progress of well-known trademark protection system in China should be self examined. This paper discusses the issues on the dilution rule instead of confusion rule concerning the well-known trademark protection, the general rule of well-known trademark recognition case by case as well as the prohibition of advertisement asserting well-known trademark in business, and gives further comments on the improvement of the well-known trademark protection.
