The Legal Interpretation on the Result of Harming Competition of Vertical Restraints

摘要纵向限制反垄断法规制以及相关研究一直是反垄断理论和实践中的一个难点。究其原因乃是纵向限制的福利效果较为复杂。从反垄断的基本法学理论出发,即杠杆理论、掠夺性定价理论、提高竞争对手成本理论和信息不完全理论,阐释其对于竞争的危害,从而为反垄断法规制奠定坚实的基础。 Vertical restraints antitrust regulation and related research has been a difficult issue in the antitrust theory and practice. The welfare effects of vertical restraints are very complicated, so it is difficult to regulate it. This paper attempts to study on the anti-monopoly law theory, such as lever theory, predatory pricing theory, improving the competitors＇cost theory and information theory, which explains vertical restraints harm competition.
