民主政治视野下的网络实名制——基于当前网络后台实名注册管理制度的再思考

On the Network Real-name System in the View of Democratic Politics

网络实名制关涉民主政治乃至和谐社会的构建。匿名性为民主政治的基础性条件,其与虚拟性网络相契合,有力推进了民主政治进程。网络实名制将削弱民主政治的基础性条件,对公民表达权产生不当限制,更有消弭网络的政治安全、促进人全面发展和"权力分散化"等优势,韩国经验也说明我国尚不具备全面实施实名制的条件。在目前后台实名注册的管理制度上,构建公民网络政治参与的法律保障机制是实现网络安全与推进民主政治的有效之道。

The network real-name system matters to democratic politics and social harmony. The anonymity ,as the natural condition of democratic politics, mesh with the netwok virtuality. The network real-name system would impair the democracy, improperly limit the the right of expression, and prevent the network＇s funciton of political security, society progress and power decentralize. Compared with Korea, there are no implement conditions for network real-name system. To build the law safeguard mechanism for network political participation would be the effective way for network security and democratic politics.
