摘要
"制片者"规则实际上是要解决影视作品版权的原始取得问题。为减少市场交易成本,保障投资人利益,我国著作权法第15条规定,影视作品的版权由投资人(法律上称为"制片者")原始取得,此即所谓"雇佣原则"。考虑到我国存在着严格的影视剧行政管理制度,投资人只有遵守这一制度才能获得影视剧市场准入,因此,在认定制片者时,应从我国的实际国情和保护善意第三人角度出发,重视许可证记载内容的权属证据效力,不能仅仅因为许可证制度具有行政管理性质就否定其效力。
" Producer" rule actually deals with original copyright acquisition of movie works. In order to reduce transaction cost and guarantee investors'interests, article 15 of Chinese copyright law provides that the original copyright of a movie be acquired by its investor, legally named "producer" , which follows "hire and employment" principle. However, given the strict regulation in the field of movie production and the necessity of obeying this regulation, the content of relevant licensing documents should be given priority when determining the identity of "producer" , which rule is more compatible with the country's reality and protection of third parties.
