摘要
"被"现象受到社会的日益关注,折射出社会管理的多重隐忧。从社会案例中梳理"被"现象的类型,以法理的视角进行多种维度的诠释,可以发现:"被"现象主要存在于公法领域,其产生及在社会蔓延的深层次原因则在于意志和权力因素的影响。要突破此种困境,消解"被"现象的困厄,则要依赖于法治型社会管理模式。该模式新颖的法治观念、重视人权与公民规训的特点,有助于实现公民权利的法律表达与权利维护的法律实践。
Along with the "bei" phenomenon being paid much more attention to,there is a reflection of multiple latent worries of social management.It can be found that,by the method of combing the types of "bei" phenomenon in social cases and interpreting it in several dimensions from jurisprudence perspective,"bei" phenomenon mainly exists in the field of public law.The profound reason for its emergence and social spread is the influence of will and power factors as well.Mainly depending on nomocracy type social management can we break through such a predicament and eliminate the distress of "bei" phenomenon.Such a mode,which takes novel ideas of nomocracy,regards human rights and civil discipline as its characteristics,can contribute to achieving legal expression of civil rights and legal practice of rights maintenance.
