摘要
"法律监督"、"检察权"是法典用词,"诉讼监督"是学理用词。法律监督有动词性倾向且政治表义浓厚。检察权是检察机关职权的抽象表述,检察职权是检察权的具体化。可对法律监督与检察权进行关系论证,不宜进行内涵比对,法律监督是检察权质的价值判断因素。诉讼监督有广义与狭义之分,不同于法律监督,不能周延涵盖检察职能。"法律监督"与"诉讼监督"不是属种关系,二者处于不同法律位阶。"检察权"与"诉讼监督"本质上是属种关系。
Procuratorial power is the abstract expression about procuratorial organs, procuratorial authority is a detailed description of procuratorial power. We can discuss the relationship a between legal supervision and procura- torial power, but cannot compare the definitions of them. The legal supervision is the essential element of prosecuto- rial power. Litigation supervision is defined in broad sense and in narrow sense, is different from legal supervision, and is not inclusive of the functions of procuratorial organs.
