论信息存储空间的法律保护——以《物权法》为视角

Protecting Information Storage Space from View of Property Law

我国尚未有法律专门针对信息存储空间的保护问题。本文由信息存储空间保护面临的危机引出我国对信息存储空间的保护现状,据此从物权法角度确立信息存储空间的法律属性和用户对其拥有的权利本质,在此基础上构思物权法视角下的信息存储空间保护方式。

China has not yet had legal protection specifically for information storage space. Many scholars be- lieve that it can be based on a Tort Liability. Tort law is, however, negative and passive means of protection. This article fist sets out the crisis of information storage space protection and then leads to the conservation status of the storage space of information.
