完善参与权对社区治理中公民参与作用的发挥至关重要。社区参与权存在的问题主要包括参与权主体范围不清晰,内容模糊,客体不清等。社区参与权保障制度体系存在的问题主要包括多元主体身份有待法律完善,参与权实现的前提性制度处于初级阶段,参与权实现的程序性制度、支持性制度、救济性制度呈空白状态等。完善社区参与权制度体系的路径应从前提性制度、程序性制度、支持性制度和救济性制度四方面着手,建立系统性参与权保障制度。

Perfection of participation right is crucial for citizens＇ participation in the community.The problems of community partic-ipation right lies in two domains,the community participation right and security system of the community participation right.The former one are subjects not clear, content fuzzy,objects not clear.The latter are multiple subjects need law＇s identity,the premise system for par- ticipation fight be in primary stage,and the process syetem,supporting system,relief system for participation fight are blank.The path of the realization of citizens＇ participation right in the community are in the systematic security system for participation right including premise system, process syetem,supporting system,and relief system.
