摘要
考察非正规用工产生的历史,辨析国外的做法,基于中国的现实,尝试提出较为务实的解决问题的思路和办法。非正规用工作为一种市场内生现象,只能限制而难以根绝。由于我国社会组织发育仍然存在限制,把构建社会权利作为基础,是适用的策略选择。
The author analyzes the history and practices of foreign countries of informal employment, and puts forward some coun- termeasures based on China' s realistic. As an endogenic phenomenon of market economy, informal employment can only be limited but not be prohibited. Due to the limitation of social organization development in China, it is the proper approach to construct social rights.
