刑罚执行的文化思考

Cultural Thinking of Penalty Execution

刑罚执行是一种特殊的文化活动。当前我国的刑罚执行不同程度地存在三大文化缺陷:简单、粗暴的"棍棒文化",过度宽容、优劣不分的"人权文化",消极应对、疏于管理的"无为文化"。文化缺陷明显妨碍"矫正犯罪,预防再犯"刑罚执行目的的实现。现状与发展要求尽快建立以马克思主义科学发展观为指导思想的"和合型"刑罚执行文化。

Penalty execution is a special type of cultural activity. There are three major drawbacks in the prevailing penalty execution in China： the simple and brutal culture of ＂hat＂; the over-tolerant and regardless-of-merits culture of ＂humanism＂; the negative and poorly administrative culture of ＂idleness＂. These cultural drawbacks are obviously the obstacles to the fulfillment of penalty execution to rehabilitate criminals and reduce recidivism. The present situation and development of penalty execution call for the immediate establishment of ＂harmony-typed＂ culture under the guidance of Marxist concept of scientific development.
