According to the provision in ＂Criminal Law Amendment（8）＂ and ＂Explanation on Time Validity of ＇Criminal Law Amendment（8）＇ from Supreme People＇s Court＂,the article analyzes the application of criminal cases put to trial after May 1,2011 so as to resolve the doubts on the application between new and old laws in judicial practice.
