论我国德治的法治化流转——兼评《机关事务管理条例(征求意见稿)》中的“三公”消费规定

On Chinas Legalization Transferred from Rule by Morality

德治与法治在一定范围内具有可转换性。基于此,德治与法治在传统的互补结构形态下,还存在着一种局部流转的结构形态。由于市场经济的冲击、公共生活本土化资源的缺失以及传统文化的弱化,随着改革开放的不断深入,在实践中出现了德治的失范问题,因此,德治的法治化流转将成为一种必然。《机关事务管理条例(征求意见稿)》将过去政府以德治理的范畴法制化,体现了德治的法治化流转倾向。

Rule by morality and rule by law has transformation in a certain range.Based on this,beside in the traditional complementary structure form of rule by morality and rule by law,there is also a local circulation structure form.In China,as the reform and opening-up opening policy is carrying on,the disadvantages of rule by morality eventually exposure.Because of the impact of market economy,the lack of the public life and native resources and the weakening of traditional culture,rule by morality change to rule by law has became inevitable.The ＂Administrative Affairs Management Ordinance（Draft）＂ law＇s promulgation legalized the category of ruling the country by virtue,which is reflected more the moral legalization in circulation.
