政务公开中的权力制约与公民权利保障

A study on the power restriction and civil rights protection of the open government

政务公开是民主政治发展的必然趋势,是世界各国行政体制改革的应有之义。政务公开在我国仍处于起步阶段,我国政务公开实施过程中出现了一些问题,如政府的自由裁量权过大、公民的知情权被剥夺等,对此,本文从政府权力制约和公民权利保障这"一体两面"上着手,提出转变政府观念、建立健全权力运行监督机制、建立沟通平台保障公民的知情权和参与权等建议,进一步发展和完善我国政务公开制度。

The open government is the inevitable trend of development of democracy around the world, and it is the proper meaning of administrative reform.At present, China＇s open government is still in its infancy, there are many problems in the implementation process, such as the discretion of the government is too large, the citizens were deprived of the fight to know. For further developing and improving the system of open government, need to start form the constraints of power and the protection of the fights of the ＂two sides of the same coin＂ , the concept of the transformation of government, clearly the powers and obligations of the government, set up the power supervision mechanism, strengthen the legal system, build communication platform to ensure citizens＂ fight to information and political participation rights.
