凉山彝族纠纷民间调解对解决农村纠纷的启示

Implications of Civil Dispute Mediation of the Yi Ethnic Minority Group of Liangshan for Solutions of Rural Disputes

本文选取了凉山彝族"德古"调解彝人社会纠纷的一个典型案例,从剖析案例整个调解过程,得出彝族习惯法中调解程序体现之特点和蕴含之精神。针对我国农村纠纷突出,血案频发的现实,指出了农村中人民调解机制的缺位和低效,提出相关解决办法和措施:增强人民调解的责任心和使命感;注重农村文化建设,加强农村道德和法律教育;注重民间调解的结案仪式,建立回访机制;加强民间劝导,构建多方面参与、全方位覆盖的农村调解网络体系。

By selecting a typical case of ＂De Gu＂ mediating social disputes among the Yi people in Liangshan, this article analyzes the whole mediating process and obtains the characteristics and spirit embodied in the mediating procedures in the customary law of the Yi ethnic minority group. Aiming at the frequent happenings of rural bloody disputes, it points out the deficiency and inefficiency of people mediating mechanisms in the countryside and puts forward the following solutions like promoting the sense of responsibility and sense of mission in the mediation; paying attention to rural cultural construction and strengthening moral and law education in the eountryside; paying attention to the settlement ceremonies of civil mediation and building re-visiting mechanisms; promoting persuasion among people and constructing rural mediating network participated by all sides and covering all areas.
