论侦查阶段精神障碍者轻微犯罪的处置

On the Handling of Mental Disorders' Minor Crime in Criminal Investigation Stage

由于主体的特殊性及犯罪的轻重程度不同,对精神障碍者实施犯罪侦查阶段的处置程序应当有所差异。我国侦查阶段精神障碍者轻微犯罪的处置程序并无相关法律规定,导致实践执法任意。域外侦查阶段警察对精神障碍者实施的轻微刑事案件进行程序分流具有一定的理论意义与实践价值。当代中国应建立侦查阶段精神障碍者轻微犯罪的程序分流机制,可在借鉴域外法治发达国家的司法经验并结合中国刑事诉讼实践的基础上展开设计,具体可从中国刑事司法体系与社会救治体系相互协作的角度来打造与运行。

Owing to the particularity of the main body and the differences of the seriousness of crime committed by the mental disorders, police handling procedure should be different. Foreign police divert mental disorders committing minor crime that has certain theoretical meaning and practical value, yet police handling procedure on mental disorders committing minor crime has no relevant law in China, which results in arbitrary law enforcement in practice. At present, China should establish the procedure diversion of police handling mental disorders committing minor crime, design in reference to the judicial experience of the developed country, combining with Chinese criminal procedure practice, which can, in particular, be built and run through cooperation of criminal judicial and social treatment system.
