见死不救立法悖论的法社会学分析

The Analysis of the Legislation of Being Indifferent to Save Strangers from Danger in the Perspective of Legal Sociology

近年来我国见死不救的事件屡发,由此引发应否对见死不救进行立法惩罚的讨论。在现实困境上,见死不救惩罚法面临着立法上的共同价值观和守法上的实效性等缺失。从法社会学角度分析,法律信仰、法律情感的匾乏和强制性法律对社会原生秩序的破坏,都是该类事件的诱因。对此,应在立法之外寻找对策,以社会自身的控制力为主导,结合司法系统的自我纠错,才能使歪曲的社会道德观重回正轨。

Being indifferent to save stranger from danger,such events frequently occurred in China,caused a heated discussion about whether a punitive law to punish those pococurante should be worked out.However,this legislation may encounter obstacles of lacking of the consolidated social values,and the law abiding effectiveness.In the perspective of Legal Sociology,the obstacles can be attributed to be？short？of the legal faith as well as the destruction of the social order which was imputed to the punitive law.In this regard,the way should be proceed from social conditions,especially the social control of itself as a leading,with self-correction of the judicial system,can return the social morality back to the right path.
