中国宪政发展历程之再审视——以《钦定宪法大纲》为切入点的分析

自晚清末年《钦定宪法大纲》颁布以来,中国宪政建设已经风风雨雨地走过了百余年发展历程。作为中国历史上的第一部宪法性文件,《钦定宪法大纲》在中国宪政史上具有重要的地位,但对其研究却遭到有意无意的"冷落"。反思和总结《钦定宪法大纲》酝酿、产生直至最后夭折的诱因和教训,无疑对中国当下法治事业和宪政建设的推进具有重要的启发意义,主要包括:认真对待宪法移植,实现宪法学的中国化,以经济建设为中心营造宪政实施的社会环境条件,注意宪政实施过程中政府的推动作用,弘扬宪政主义尊重和保障人权的价值意蕴,密切关注宪法规范与社会生活之间的互动。

Since the enactment of the Outline of Imperial Constitution at the end of the Qing Dynasty, China has gone through the developmental process of a century ups and downs. As the first constitutional document of Chi- na ,the Outline of Imperial Constitution was granted very important status in the constitutional history of China. To review and reflect the abortive reasons and lesson of the Outline of Imperial Constitution, it will undoubtedly provide useful inspiration for the cause of ruling by law and the building of constitutionalism in present.
