试论违宪审查与全国人大的关系

The Relationship Between Review of Constitutionality and NPC

违宪审查在我国建立的阻力是多方面的,其中违宪审查与全国人大的关系是一个理论难题。但是依据宪政与法治的一般原理和我国的实际情况,这个理论难题能够被妥善解决。全国人大的权力应当被制约而且可以被制约,设立一个制约全国人大权力的违宪审查机构并不违反社会主义的"议行合一"原则,违宪审查不会影响全国人大的最高宪法地位。

In many resistances of electing the system of review of constitutionality of China, the relationship between review of constitutionality and NPC is a difficult theory problem. However, the difficult theory problem could be resolved in terms of general principle of constitutional government and rule of law and Chinese actuality. The power of NPC should be restricted and can be restricted . The establishment of a wheel of review of constitutionality which aims at restricting the power of NPC is not contrary to the socialistic principle of combination of legislative and executive powers. Therefore, the system of review of constitutionality cannot weaken the highest constitutional position of NPC.
