追求并拥有幸福,如同追求自由、平等一样,是世界各国人权体系的重要组成部分。然而,幸福权的形成,却不是一以贯之的。在西方思想史上,"幸福"有着不同的面相,自古希腊以降,历经数千年不断的观念转换,最终形成了幸福是一种权利的观念。幸福权是一种主观性的权利,与人的个体性有关,因此不同主体有着不同的幸福权。在中国语境中,幸福权的形成有特定的历史根基和历史沉淀。

Pursuing happiness, as pursuing freedom and equality is an important part of the human right system all over the world. However, the formation of the right to pursue happiness is not always consistent. In the history of western thought, ＂happiness＂ had different faces. Since ancient Greece, this concept has undergone thousands of years to change, and that ＂happiness is a concept of rights＂ was ultimately formed. The right to pursue happiness is subjective, connected with the human individual. Different subjects have different happiness. The formation of the right to pursue happiness has specific historical roots and historical precipitation in Chinese contexts.
