论社区矫正对预防毒品犯罪的作用

Discussion on the function of Community Correction in preventing drug-related crime

作为全球性社会公害,毒品犯罪在中国已成为一个很严重的社会问题。传统意义上,预防毒品犯罪通常适用监禁矫正。在报应性理论影响下,此意义上的监禁刑阻止了监禁矫正在预防毒品犯罪中作用的发挥。而社区矫正则可弥补监禁矫正的缺陷,并会对预防毒品犯罪起到一定积极作用。因此,中国现阶段已经开始适用符合中国国情的社区矫正来预防毒品犯罪。但是,完全适用社区矫正来预防毒品犯罪仍有待进一步完善。

Drug- related crimes is a global social nuisance and has become an important social issue in our country. Traditionally, imprisonment was applicable to prevent drug - related crimes. In this sense, the theory of retribution hindered the function of imprisonment in drug - related crime prevention. With the deepening of studies on crime prevention theory, we find that community correction is not only able to remedy the defect of imprisonment but also has a role to prevent drug - related crime. Now our country has been using community correction, which is suitable to our national conditions to prevent drug - relat- ed crime. ＇But there are still some aspects that need to be improved in completely application of communi- ty correction in preventing drug -related crime.
