长株潭两型“试验区”区域法制配套研究

A Supporting Study of the Regional Legal System of "Two-oriented" Test Area in Chang-Zhu-Tan Agglomeration

目前,理论界和实务界对保障长株潭地区区域"两型社会"建设的法制研究不足,而解决长株潭试验区法制不健全就需要借鉴国际国内区域法制合作模式以完善区域内"两型"法制建设。完善长株潭地区法制配套,可以从以下四方面着手:首先,以省级立法为主,制定适用于"两型社会"实验区的地方性主干法规:其次,建立区域合作法律机制和区域法律冲突救济法律机制;再次,根据相关法律法规和人大的授权,确定长株潭先行先试权的边界;最后,完善清理现有政策法规冲突的长效机制。

At present, we have inadequate research of legal research which guarantees ＂Two-oriented Society＂ construction in Chang-Zhu-Tan area in theory and practice. But, to solve the imperfect legal system of Chang-Zhu-Tan Experimental Zone needs to learn from international and domestic regional legal cooperation mode, to perfect regional ＂two type＂ legal construction. The perfection of legal supporting system of Chang-Zhu-Tan area can be carried out from the following four aspects： First of all, Mainly to provincial legislation, we work out local trunk laws and regulations that apply to ＂two type society＂ experimental zone; Second, we establish the legal mechanism of regional cooperation and the regional conflict of law relief system; Third, according to relevant laws and regulations and the authorization of National People＇s Congress, we determine the pilot power boundary of Chang-Zhu-Tan. Finally, improve and clean up the lasting effect mechanism of existing policies and regulations conflict.
