摘要
小产权房是我国房地产市场变革发展过程中一个阶段性的产物,其数量众多,并且多是违法建筑,因而治理难度大。这种小产权房对国家经济建设、土地和房屋交易市场的发展造成了较大冲击。笔者认为,现行的以没收为主的治理形式和放任地方自行处置的方式都不太合适,而采用国有化的方式,则可以兼顾国家、集体和购买者等多方利益,有效治理小产权房问题,这是维护土地和房屋交易市场长治久安的根本之策。小产权房应该国有化并切实实施。
Houses with limited property rights are the product of the reform and development of China's real estate market in a phrase. The houses are great in number and most of them are illegal constructions, which are difficult to administer. They have a negative impact on China economic construction and development of land and real estate transaction market. But the present governance is inappropriate, dominated by confiscation and? at the disposal of local governments. Nationalization is an effective way to solve the problem by ensuring such interests of multi-parties as state interests, collective interests and house purchasers' interests. It is a fundamental policy for maintaining the long-term stability of land and housing market. Thus, houses with limited property rights should be nationalized and the nationalization should be implemented.
