侵犯知识产权犯罪中所涉及的罪数形态主要包括牵连犯、想象竞合犯、法条竞合犯。生产、销售伪劣产品过程中又假冒他人注册商标、专利或伪造商标标识的行为属于想象竞合犯,应从一重处断。非法制造他人的注册商标标识,又在同一种商品上使用该标识,成立牵连犯。生产、销售伪劣产品罪与生产、销售不符合卫生标准的化妆品罪成立法条竞合,两罪与危害公共安全犯罪,符合想象竞合的特征。
