刑讯逼供的挫折攻击理论研究——社会学视角的分析和建议

On Examination of Torture in Criminal Detection Based on Frustration and Aggression Hypothesis——Advice and Analysis from Sociological Perspective

刑讯逼供现象作为法治社会建设的一大障碍,被理论学界长期关注,检视过往对于该现象的研究,更多的关注于其"违法性"特征,忽略了这一现象的"攻击性"本质。而刑警的挫折感对于其采取的攻击性侦查讯问行为有着直接、密切的关联性。作为刑事讯问主体的刑侦民警的挫折感不仅仅来源于职业行为和与犯罪嫌疑人的直接对抗,社会层面上对于刑警队伍的一些不良影响为其挫折感产生提供了更深厚的社会土壤。遏制刑讯逼供,不能期待讯问人员单方面的加强自我约束和克制,而应当从外部入手,特别是设立一系列的使侦查顺利开展的支援保障制度,消减负面压力,减轻讯问人员负担,把讯问程序纳入一个规范化的轨道。

As the main obstacle to the construction of society ruled by law, the torture in criminal detection has been concerned by theoretical academic for a long period. Reviewing the past study about this phenomenon, we can find that more attention has been paid to the illegality of it, while the aggression of it has been neglected. The author of the thesis conducted a social survey direct to criminal investigation department around the country. Based on the aggression of torture, the author pursues to define the phenomenon by frustration and aggression hypothesis by analyzing the feedback of the social survey from the perspective of sociology.
