完善未成年人社区矫正工作的构想——以未成年人刑事案件检察工作为视角

The Blueprint of Perfecting Juvenile Correction in Community——from the Perspective of Juveniles’ Criminal Case Supervision

我国目前尚未形成专门针对未成年犯罪者的社区矫正法律法规和工作机制,上海完善未成年人犯罪社区矫正体系的对策主要有:将审前帮教考察与判后矫正相结合,确保社区矫正的合理性和有效性;进行未成年人社区矫正立法,明确社区矫正部门权责、矫正细则;规范社区矫正机构、配备专业人员,科学设置符合未成年人特点的社区矫正项目。

China has not yet made laws and regulations and not formed the working mechanism concerning juvenile criminals and their correction in community. The countermeasures of perfecting the system of juvenile correction in community are： 1） to combine the education before trials and correction after conviction so as to ensure the necessity and reasonability of the community correction; 2） to make laws targeting the juveniles＇ correction in community to make clear the responsibilities and shares; 3） to standardize the correction facilities which should be manned with professionals and set up community correction programs that suit the juveniles＇ characteristics.
