摘要
就船舶优先权法律适用问题,我国学者中存在着较为普遍的反对法院地法、赞同船旗国法的观点。法院地法固然有其缺陷,但更多的所谓弊端是学者杞人忧天。由于方便旗船的盛行和船旗变更两大问题及其他相关考虑,船旗国法不宜成为船舶优先权的准据法。若不能在法律修改中客观而精细地运用最密切联系原则,维持法院地法规则比改弦更张为船旗国法规则更适宜。
When it comes to law application of maritime liens, scholars in China generally oppose lex fori but support the law of the flag state. Lex fori indeed has its own defects, but most of which are no more than scholars" unnecessary worries. It is not proper that the law of the flag state should be applicable law of maritime liens considering the two main problems: prevalence of ship with flag of convenience and change of ship flag. If the principle of proximate connection cannot be arranged in our law amendment ob- jectively and delicately, it is reasonable to preserve lex fori without substituting the law of the flag state for it.
