Legal Language Translation from the Pragmatic Perspective

法律语用修辞是具有法律文化负荷的用语,是词汇语义民族性的一种表现,具有鲜明的民族法律文化特色。为实现法律文本翻译的严谨性和准确性,译文不仅要从词法和句法两个层面转达原文信息,而且要透过语言形式体现其文化语用内涵,体现中外法律文本特有的文化内容在法律语言中所产生的语义效果及不同的语用特征。文章拟通过探讨法律语用修辞对于法律文化的构成性作用,从而使法律文本翻译能够超越语言的表面形式兼顾文化和语用内涵而实现功能对等。

Legal pragmatic rhetoric refers to the culture-loaded legal terms,which demonstrate the semantic characteristics of a nation with striking features of a nation＇s legal culture.To achieve the precision and accuracy in the translation of legal texts,the translation needs to put across the meaning of the original version not only at the morphological or syntactical level but also at the cultural level.The cultural implication in the texts shown by the semantic effects and the pragmatic features needs to be produced in the translation.The article tries to study the role of the legal pragmatic rhetoric in the formation of the legal culture to help achieve a functional equivalent translation of the legal text conveying the cultural and pragmatic meanings of the original legal text.
