The Study of Fostering and Custody of Minor Children after the Divorce of Their Parents

本文对父母离婚后未成年子女的抚养、监护以及两者之间的关系作了细致梳理,提出父母离婚后在未成年子女的抚养、监护问题上法律应确立这样的标准,即规定除了某些例外情况,子女和父母之间的个人的、直接的和经常的联系应予维持。

This article makes a careful analysis about the fostering and custody of minor children and the relation- ship between the two problems, and believes that law should establish some criterions for the problems about the fostering and the custody of minor children after their parents divorced, which support the maintenance of the in- dividual, direct and regular contact between minor children and their parents apart from some exceptional condi- tions.
