诗说“法的诗性”——以法律拟制为例

"Poetic Virtue of Law" in Poetic Vision ——A Case Study of the Fiction of Law

法,不仅是逻辑的,还可以是诗性的。在内容上,以法律拟制为例,通过三个方面阐释法的诗性,即思维上的"好像"性:第一,法律拟制的运作过程、运行效果以及静态结构;第二,《诗经》"采"字诗所描绘的"纳入拟制"的形象;第三,法律拟制中的"拟词"。在方法上,尝试用形象化的方法去阐释法的诗性。席勒说:只有通过"美"这扇清晨的大门,你才能进入认识的国土;在相似的意义上,或许通过"诗"这扇"清晨的大门",才易看到"法的诗性"。

Law is not only logical,but poetic.This article,with the example of the fiction of law,explains the poetic virtue of law,namely,the ＂similarity＂ in thoughts： 1.the operating process and results and static structure of legal fiction;2.the image of ＂taking into fiction＂ depicted by poems with characters of ＂picking＂ in Book of Poetry;3.The imitating words in the fiction of law.In terms of method,visualized methods are employed to illustrate the poetic virtue of law.Schiller said,＂it is ＂beauty＂,the door of early morning that leads you to the land of truth,and in a similar sense,perhaps only ＂poetry＂,the door of early morning,makes it possible to realize ＂poetic virtue of law＂.
