论用益物权在物权法中的地位——以土地用益物权为例

On Position of The right of usufiuct in The Law of Property right

用益物权地位的变化反映了现代物权法的重要发展趋势 ,有些学者主张用益物权在物权中的“中心”地位的观点有待商榷 ,以土地不动产为例可以进一步论证完全物权 (所有权 )的地位才是物权的“中心”。在立法和实践中当务之急是整固土地所有权的控制力 ,即完善土地所有权的效力和实效。

Changes in the position of the right of usufiuct shows an important trend of development in modern law of property right. Some scholars are now questioning the central position of the right of usufiuct property right in the law of property right. They point out that it is the real property right that holds the central position of property right. A good case in point is the land real estate.The author suggests that measures have to be taken to strengthen control of property of land in the process and practice of legislation in order to perfect validity and effect of the property of land.
