专利池制度是一个拥有150多年历史的专利制度,也是西方发达资本主义国家自知识产权诞生以来产生的重要专利制度之一。在专利法制度发展的历史过程中,经历了由盛至衰的过程。随着全球经济进入知识经济时代,专利池制度也走上了复兴之路。面对国外许多大型跨国公司、企业运用知识产权的垄断性在全球范围内大肆攫取垄断利益的同时,中国企业也面临着新的挑战。因此,我们必须合理运用反垄断的相关法律,对专利池滥用行为进行规制。

Patent pool, a most important patent legal system ,has a history of 150 years history. When the whole world has entered the era of knowledge economy, the patent pool has begun to revive. More multinational corpora- tions and enterprises abuse the intellectual property rights to seize interests, and China＇ s enterprises are also faced with new challenges. So, we must use the antitrust laws to regulate the abuse of patent pool.
