摘要
在经济全球化背景下,国际劳工组织提出的"体面劳动"越来越受到世界各国的关注。展开多形式和多层次的社会对话是实现"体面劳动"的重要途径,这一点已经逐渐成为国际社会的共识。而集体谈判制度是实现社会对话的最完整、最普遍的形式,它能在相当程度上弥补劳动者个体分散、无序的劣势,切实维护雇员利益,协调劳资关系,充分实现体面劳动。文章在分析集体谈判制度的作用机理的基础之上,根据我国不同层次劳动者对集体谈判的需求以及国际劳工组织对实现体面劳动的具体要求,构建出符合我国国情的集体谈判制度。这是当前在我国社会主义市场经济条件下充分实现体面劳动、解决劳资冲突、增进劳资合作的最有效途径之一。
In the context of economic globalization,the concept of decent work proposed by the International Labor Organization (ILO) is receiving close attention by more and more countries. One of the most important ways to achieve decent work is through multi - form and muhi - level social dialogue, and this idea has gradually become an international consensus. The collective bargaining system is the best and most universal form of social dialogue, and it can make up for the disadvantages scattered and unorganized individual workers have to a considerable extent, and effectively achieve the aim of safeguarding the interests of employees and coordinating labor relations. In this way, we can fully realize the target of decent work. On the basis of an analysis of the mechanisms built into the collective bargaining system and according to workers' different levels of demand for collective bargaining and the ILO's specific requirements to achieve decent work, this article tries to build a system of collective bargaining in line with China's national conditions. This is one of the most effective ways of fully reali- zing the target of decent work, resolving labor conflicts, and improving labor - management cooperation in China's current socialist market economy conditions.
