入河排污口监管立法的不足与完善

Defects and perfection in legislation on monitoring river sewage outlets

当前我国入河排污口日益增多,排放废污水不断增加,形势日趋严峻,实行最严格水资源管理制度对它提出了新的更高要求。现行相关立法对入河排污口监管问题作了一些规定,但在监管范围、行政审批和法律责任等方面仍然存在不足,不能适应新的形势需要。建议进一步加强入河排污口监管立法,统一扩大监管范围,实行更加严格的区域限批政策,强化法律责任机制,出台有关技术规范。

At present, the situation is becoming severe as the river sewage outlets and the volumes of discharged waste water are increasing, so that it raises new and higher requirements for implementing stringent water resources management system. Although some stipulations on monitoring the river sewage outlets have been made in the relative legislations, there are still some defects such as monitoring scope, administrative examination and approval and legal responsibilities that can not adapt to the new situations. Suggestions are made to strengthen legislation on the rive sewage outlets by uniformly expanding the monitoring scope, implementing more stringent policy on regional restrictions approval, strengthening the legal responsibility mechanism as well as introducing relevant technical specifications.
