市场经济的发展离不开商务谈判,商务谈判在某种意义上讲受到法律、特别是法律思维的制约。在对商务谈判与法律思维内在关系进行分析的基础上,着重分析了商务谈判中法律思维的基本结构及其作用机制。商务谈判中法律思维的基本结构包括合法性思维、平衡性思维、程序性思维、说理性思维和创造性思维。这些思维作用于商务谈判形成合法谈判机制、利益均衡机制、法律创造机制、程序控制机制、说理机制。研究商务谈判法律思维的构成及作用机制,对谈判学的学科发展和丰富谈判实践,都有着重要作用。

The development of the market economy is inseparable from the business negotiation.Business negotiation,in some sense,is constrained by the law,especially by legal thought.Based on analysis on the intrinsic relationship between business negotiation and legal thought,this study focuses on the analysis of the basic structure and action mechanism of the legal thought in commercial negotiation.The basic structure of the legal thought in business negotiations includes legal thought,balanced thought,programmed thought,rational thought and creative thought.These thoughts act on business negotiation,forming legal negotiation mechanism,interest balance mechanism,the law creating mechanism,procedure control mechanism,and reasoning mechanism.The study of the form and mechanism of negotiation plays an important role for the development and enrichment of negotiation practice.
