摘要
根据1901《辛丑条约》的规定,清政府与英、美、日三国分别进行了修改通商条约的谈判。在谈判中,英、美、日三国谈判代表分别提出了保护其在华知识产权的要求条款。清政府谈判代表与各国代表讨价还价,在保护外国在华知识产权问题上,尽可能地保障中国的主权和利益。最后达成的1902年中英商约、1903年的中美商约、1903年中日商约分别规定了对外国在华商标、版权和专利权进行保护的原则和办法,但又照顾了中国的实际情况。
To carry out the stipulation of the Final Protocol in 1901, Qing government negotiated with the United Kingdom, the United States and Japan to amend the commercial treaties. In negotiations, the commissioners of the U. K., the U. S. and Japan respectively came up with their own articles to protect their intellectual property rights in the new treaties. Chinese commissioners tried their best to protect Chinese sovereignty and interests while negotiating with the commissioners from other three countries about the protection of intellectual property rights in China. The new commercial treaty between China and the United Kingdom was signed in 1902, and the other two between China and the United States, and between China and Japan, in 1903, which either stipulated the principles and methods to protect trademarks, copyrights and patents of these countries in China and took China' s interests into account seriously.
