摘要
秦汉时期,伴随着私有经济的发展,各种涉及财产、婚姻、人身侵权等民事案件出现。国家不仅制定了严苛的民事法规,并相应建立一整套民事诉讼制度,确保对各类民事案件的预防和控制,维护封建道德和社会秩序。从已出土的《睡虎地秦墓竹简》、《张家山汉墓竹简》、《居延新简》等简文资料,可窥探秦汉发达和精细的诉讼程序。
Various cases concerning property, marriage and personal civil infringement occurred with a private economic development in Qin and Han Dynasties. Civil laws and statutes have been laid down by nation during Qin and Han Dynasties. We can probes into the e- laborate and advanced civil litigation procedure from bamboo and wooden slips unearthed in Shuihudi,Zhangjiashan and so on.
