Relations of the Prosecutorate and the Police in Vietnam's Criminal Procedure and Its Revelation

越南现行检警关系模式赋予了检察院在审前阶段十分广泛的权能,检察院有权对侦查机关的人员及活动进行强有力的监督和引导。基于中国与越南相似的政治、经济条件和文化、历史传统、人文素质以及此前相近的司法体制,越南现行检警关系模式及其运行效果对我国的检警关系改革具有一定的参考价值。

Vietnam＇s criminal procedure law has vested the procuratorate with very strong power and functions in the pre- trial stage, the procuratorates have the right to supervise and instruct the investigative organs and their activities. China and Vietnam are quite similar in po- litical and economic conditions,historical and cultural traditions, and judicial systems. The relations of the prosecutorate and the police in Vi- etnam＇ s criminal procedure have some reference value to the reform of the relations between the prosecutorate and the police in China.
