“征转分离”土地审批管理模式初探

A Preliminary Study on the Approval and Management System for the Separation of Land Requisition and Land Transition

在分析现行土地转用征收管理模式及其弊端的基础上,探讨"征转分离"土地管理模式的优势与必要性,并提出了"征转分离"土地审批管理模式的规范化管理措施和优化设计建议。研究结果表明,"征转分离"土地管理模式具有补偿安置先行,保障农民权益;提高转用效率,避免土地闲置;提高新增建设用地指标分配的科学性等作用。为提高"征转分离"土地管理效率,促进征地制度改革,应从征地规模控制、占补平衡控制、安置补偿控制、土地用途控制几方面入手,对其进行规范化管理。

Based on the existing management model of land requisition and land transition and its deficiencies, both the advantages and dis- advantages and necessities of the management model for land requisition and land transition were discussed, and then some suggestions were proposed on standardizing and optimizing the approval and management system for the separation of land requisition and land transition. The results showed that the management model for the separation of land requisition and land transition can play a role in protecting farmers＇ legal rights, improving the efficiency of land migration, avoiding idle lands as well as improving scientific allocation of new construction lands. It is concluded that in order to improve the land management efficiency and promote the land requisition reform under the separation of land requisi- tion and land transition system, the land expropriation scale, the requisition and compensation balance and land uses should be controlled.
