On "Same Crime and Different Punishment" of Tang Law on the Legislation of Domestic Violence from a Gender Perspective

法典规范着社会的运行秩序和等级秩序,它以显性的方式规定着社会伦理和生活习俗中的隐性内容,而其中对不同对象处罚的差别则反映了其社会地位的差异。因此从唐律对男女的同罪不同罚的律条中,我们可以考察男女法律地位与社会地位的差异,进而考察当时社会性别观念与法律相互作用的关系等一系列问题。

The code regulates society running order and hierarchical order, and it sets the hidden content in social ethics and customs with the dominant provisions, but the difference between different objects of punishment reflects the differences in social status. Therefore, we can examine their legal status and differences in social status from the Tang Law on women and men ＂same crime and different punishment＂, then investigates the relationship between the concept of gender and legal interaction.
