新刑诉法视域下侦查讯问之展望——基于未成年人犯罪命案的实证分析

The Prospect of Interrogation under the Horizon of Criminal Procedure Law Amendment——An Empirical Analysis Based on Juveniles Murder Cases

未成年人犯罪导致的命案在我国目前命案的类案统计中占有一定的比例。由于未成年人的生理和心理特点与成年人的差异性,在侦查讯问中,要针对其心理特点展开审讯。我国新修订的刑事诉讼法中,对未成年人的诉讼程序设置了特别程序,其目的是为了加强对未成年犯罪嫌疑人的权益保护。侦查机关的主要职责就是查明案件事实,依法打击犯罪,但在法治的环境下保证犯罪打击与人权保障的最大化平衡,这是学界关注的焦点。

The juveniles crime makes a lot of murder cases in China at present. Because of the differ-ences between juveniles and adults in both physiology and psychology, during the interrogation, it must be carried out according to their particular psychology（ The special procedure of juveniles is written into Crim-inal Procedure Law Amendment for the purpose of juveniles suspect＇s right protect. To find the truth and beat the crime are the duties of criminal investigation department, but scholars focus on how to keep the balance between countering crime and protecting right in a legal state.
