The Criminal Law Interpretation of the Distribution Action of the Crime of Infringing Copy Right

知识产权法与刑法有关"发行"的规定归属于两个问题(发行权与发行)、演绎为两种视角(权利解释与行为解释),这决定了刑法对侵犯著作权罪发行行为进行独立评价具有正当性基础。侵犯著作权罪发行行为的实质内涵是将制作完成的侵权复制品发出。侵犯著作权的产品被非法复制后的首次销售行为构成侵犯著作权罪中的"发行";首次销售后,针对该批侵权复制品的批发、零售行为构成销售侵权复制品罪中的"销售"。

The provisions of distribution of intellectual property rights law and criminal law belong to two different categories （the distribution rights and action） and can be deducted into two views （the inter-pretation of rights and action）. It determines that it is reasonable to give an independent interpretation for the distribution action of the crime of infringing copy right. The material meaning of distributing is the ac-tion of release after the infringing goods having been made. The fist action of sale constitutes the distribu-tion action of the crime of infringing copy right;the other actions of wholesale or retail all constitutes the action of sell.
