我国腐败官员外逃及应对之策

The Status and Countermatures of Corrupt Officials Flee Overseas in China

当前,腐败犯罪全球化、国际化趋势明显,腐败官员潜逃境外现象层出不穷,严重危害社会经济、政治与法制,为民众所诟病。我国政府高度重视腐败官员外逃问题,大力开展境外追逃工作,通过引渡、非法移民遣返、劝返等措施,取得一定成效。但是,腐败官员境外追逃存在诸多障碍,因此,建议通过建立和完善党员干部家属移居海外报告和备案等制度,建立预防腐败官员外逃的长效机制,同时,灵活运用量刑、不判处死刑等承诺,进一步加强腐败官员境外追逃的国际合作。

Being seriously harmful to the social, economic, political and legal system, the trend of globalization and international of corruption crime has become increasingly prominent, and the phenomenon of corrupt officials fled overseas continue to emerge at present, both of them lead the public to a very dissatisfied situation. The Chi- nese government attaches great importance to doing vigorous measures which include extradition, repatriation of ille- gal immigrants, persuading to return and others to solve this very issue. However, considering many obstacles and difficulties exist in overseas pursuit of fled abroad corrupt officials, this paper suggests that we shall establish and improve some long-term mechanisms of prevention of corrupt officials flee overseas by reporting and recording institu- tional systems of the emigration of party members and cadres＇ families, and flexibly use sentencing recommendation and non-imposition of the death penalty proposal to strengthen international cooperation.
