论相对破裂主义在我国的适用问题

随着我国离婚数量的快速上升,离婚的标准受到了人们的广泛关注,特别是在一些特殊情形的离婚案件中,各方都关注法律是否能公正适用。总的说来,法院在裁判是否离婚时会慎重抉择,因为处理不当的话将会引发一系列的社会矛盾。不可否认,目前我国《婚姻法》中,关于离婚标准的规定存在立法缺陷。因此,探讨"相对破裂主义"作为《婚姻法》的离婚标准之一在我国也就具有了积极意义。相对破裂主义在我国具有一定的理论基础,其在我国立法和司法实践中具有必要性和可行性,我国应该借鉴他国立法经验,在《婚姻法》上作出明确规定。

With the rapid increasing in the number of divorced people in our country, the divorce standard also has received people＇s great attention, especially in some special divorce cases, all parties are highly concerned with the legal justice. Generally speaking, the magistrates court will be very discreet in handling divorce cases, because if not properly handled, a series of social contradiction will be caused. We cannot deny that the present standard of divorce legislation in our country has defects.Therefore, it is very significant to explore the relative incompatibility as one of the divorce standard in our country. At the same time, relative incompatibility has its theory basis, the necessity and the feasibility in our country; therefore China should draw lessons from the legislation experience of other countries and should clearly define relative incompatibility ＂in Chinese ＂Marriage Law＂.
